MICRON/ALENDA, shall only supply goods to you "The Customer" on the following terms and conditions of sale unless we agree, in writing, to vary these terms and conditions

1. TERMS OF PAYMENT

A. Approved credit is extended the discretion of MICRON/ALENDA and may be withdrawn without notice temporarily or for an extended time at our discretion.
B. All invoices are due and payable in full 30 days from the date on the invoice.
C. If you "The Customer" fail to pay any invoices by the due date period
I. Then there may be interest charged on any overdue invoices at the rate of 1%, calculated and payable daily.
II. The customer shall pay all our costs and expenses, including legal costs, which may be incurred in the recovery or attempted recovery of the overdue invoices from the customer.
D. Non approved accounts will be strictly C.O.D
E. MICRON/ALENDA reserves the right at any time to demand full or partial payment before processing with an order.

2. PRICING AND DELIVERY

A. All prices are subject to change without any notice.
B. GST will be inclusive at the date of invoice
C. While we will use all endeavors to comply with The Customer's delivery requirements, the customer will not be entitled to cancel the order and claim compensation by reason of failure to comply with the customer delivery requirements.

3. RESERVATION OF TITLE

A. All the goods supplied to the customer are subject to retention of title. Ownership of the goods sold by us is only transferred when the customer has paid all amounts in full owing to MICRON/ALENDA, and until such time MICRON/ALENDA reserves the right to call for recovery of the goods at our option.
B. In the event of the appointment of a receiver and manager, liquidator, Agent in possession of execution of distress, MICRON/ALENDA may enter the customers premises or elsewhere where the goods are stored or installed and recover them. The customer acknowledges and guarantees such right of entry.

4. RISK

A. The customer accepts all the risk and damage to the goods, whether caused by you or not, following the delivery and installation of the goods.


5. CLAIMS

A. No claims for any reason whatsoever will be recognized unless made in writing within 7 days of date of purchase or installation.
B. Where air-conditioning and heating equipment has been installed, operation will only be guaranteed with proper and adequate wall and ceiling installation.

6. RETURN OF GOODS

A. MICRON/ALENDA will not accept returns for credit without prior authorization.
B. Any goods accepted for credit will only apply if it is in original packaging and accompanied by documentation showing.
I. Customers Name, Address and Account Number
II. Copy of original invoice and Delivery Docket.
III. Reason for return
C. In the event that MICRON/ALENDA authorizes the return of any goods, it must be carried out by our nominated carrier at the customer's expense.
D. All returned goods are subject to 15% restocking fee.

7. CLERICAL ERROR

A. MICRON/ALENDA reserves the right to correct clerical errors with notification.

8. GOVERNING LAW

A. The laws of the state of Victoria govern all trading.
B. The Customer agrees with MICRON/ALENDA to submit to the non-exclusive jurisdiction of the Courts of Victoria and the Federal Courts of Australia and agree that any legal proceedings may be heard in these courts

9. WARRANTY

A. Warranty period is from date of invoice to the original purchaser.
B. All work carried out by any installers must be done by qualified/licensed installers and supply both Pluming Industry Commission Compliance Certificate and Electrical Safety certificate.
